1) Benefits for investors in Argentina under the RIGI

The benefits for investors in Argentina under the RIGI are very significant and varied: tax, customs, and exchange benefits.

2) Tax benefits

The main tax benefits for investors in Argentina under the RIGI are:

a) Income tax

The single project vehicle developing the investment (Vehículo de Proyecto Unico, hereinafter, the VPU)[1] will enjoy:

(i) A lower and unique income tax rate, compared to the general corporate income tax rate of 35%. This specific RIGI rate is 25%;

(ii) An accelerated asset depreciation regime;

(iii) A regime for offsetting losses that is much more favorable than the general regime, with no time limit and with the possibility of transfer;

(iv) A lower rate for VPU dividends after seven years of adherence to the RIGI: 3.5%, instead of the general 7% for corporate partners’ income tax;

(v) Among others.

b) Value Added Tax

The main benefits for investors in Argentina under the RIGI are:

(i) The possibility to cancel VAT with tax credit certificates;

(ii) Among others.

c) Tax on credits and debits to bank accounts

VPUs can compute 100% as a credit against income tax.

3) Customs benefits

The main customs benefits for investors in Argentina under the RIGI are:

(i) Exemption from import duties, statistical tax, and any tax collection regime on imports for consumption and temporary imports of new capital goods, spare parts, parts, components, and inputs;

(ii) Exemption from export duty on exports for consumption after the third year of adherence to the RIGI. For Long-Term Strategic Export projects, the exemption starts after the second year of adherence;

(iii) RIGI benefits may be combined with those of free-trade areas;

(iv) Among others.

4) Foreign exchange benefits

The main foreign exchange benefits for investors in Argentina under the RIGI are:

(i) Certain percentages of exception to the obligation of settlement in the foreign exchange market of the currency proceeds of collections of exports of goods from RIGI projects are established, with even broader benefits in the cases of Long-Term Strategic Export[2] VPUs;

(ii) Exception from the obligation to settle in the foreign exchange market foreign currency proceeds from capital contributions, loans, or services;

(iii) In principle, no limitations will apply to the holding of liquid or illiquid foreign assets, although there may be exceptions for liquid foreign assets abroad;

(iv) Among others.

5) Tax, customs, and exchange stability

The main benefits for investors in Argentina under the RIGI in terms of stability are:

(i) VPUs enjoy tax, customs, and exchange stability for 30 years: the benefits granted are acquired rights and cannot be taken away or modified detrimentally. VAT and social security contributions are exempted from tax stability;

(ii) On the other hand, they can take advantage of the repeal of taxes or reduction of tax rates that may be provided for in the future;

(iii) In the case of Long-Term Strategic Export Projects, the application authority may extend the stability guarantee of the projects to be executed in successive stages up to 30 years after the estimated start-up date of each stage;

(iv) Among others.
